HOUSE OF THREAD EMBROIDERY

Client Terms and Conditions Agreement

By placing an order with House of Thread Embroidery (“House of Thread,” “we,” “our,” or “us”), the client (“Client,” “you,” or “your”) acknowledges that they have read, understood, and agreed to the following terms and conditions. These terms apply to all orders, whether placed online, through social media, by email, text message, phone, or in person.

1. Acceptance of Terms

These terms and conditions are publicly available and are considered accepted upon submission of an order, payment of an invoice, approval of artwork, delivery of goods for customization, or any other business transaction with House of Thread. No signature is required for acceptance.

By doing business with House of Thread, you acknowledge that you have had the opportunity to review these terms and agree to be bound by them.

2. Artwork Approval and Responsibility

House of Thread will provide proofs, mockups, or artwork approvals when deemed necessary.

The Client is solely responsible for carefully reviewing all artwork, including but not limited to:

  • Spelling

  • Grammar

  • Names

  • Dates

  • Phone numbers

  • Website addresses

  • Colors

  • Sizing

  • Placement

  • Design elements

Once artwork is approved by the Client, House of Thread is not responsible for any errors, omissions, misspellings, incorrect information, or design issues contained within the approved artwork.

Any corrections requested after approval may result in additional charges and production delays.

3. Customer-Supplied Items

Clients may provide their own garments, hats, bags, blankets, or other items for customization.

While House of Thread exercises reasonable care during production, embroidery and customization involve machinery, needles, thread tension, heat, and other processes that carry inherent risks.

House of Thread is not responsible for:

  • Manufacturing defects in customer-supplied items

  • Hidden flaws in fabrics or materials

  • Shrinkage, discoloration, puckering, tearing, or damage resulting from the customization process

  • Variations caused by the item’s material or construction

If a customer-supplied item is damaged during production, House of Thread reserves the sole discretion to determine whether replacement will be provided by House of Thread, by the Client, or not at all.

Replacement decisions will be made on a case-by-case basis and House of Thread’s determination shall be final.

4. Production Variations

The Client acknowledges that embroidery is a handcrafted production process and slight variations may occur, including:

  • Thread color differences

  • Placement variations

  • Stitch density differences

  • Garment color variations

  • Size and scaling differences

Such variations are normal and do not constitute defects.

5. Deposits and Payment

All invoices are due according to the terms stated on the invoice.

House of Thread reserves the right to require full or partial payment before production begins.

Completed orders may be withheld until payment has been received in full.

6. Custom Orders Are Non-Refundable

Due to the custom nature of embroidery and personalized products:

  • Deposits are non-refundable.

  • Custom orders are non-refundable once production has begun.

  • Personalized or customized items may not be returned or exchanged unless House of Thread determines there was a production error caused solely by House of Thread.

7. Order Changes and Cancellations

Changes requested after artwork approval or after production has begun may not be possible and may incur additional fees.

Orders canceled after production begins are not eligible for refunds.

8. Turnaround Times

Estimated turnaround times are estimates only and are not guaranteed unless otherwise agreed to in writing.

House of Thread is not responsible for delays caused by:

  • Shipping carriers

  • Supplier shortages

  • Weatheryy

  • Equipment failure

  • Client approval delays

  • Circumstances beyond our reasonable control

9. Pickup and Shipping

House of Thread is not responsible for packages lost, delayed, stolen, or damaged after they have been transferred to a shipping carrier.

Risk of loss transfers to the Client upon shipment or pickup.

10. Intellectual Property

The Client represents and warrants that they own or have permission to use any logos, artwork, trademarks, designs, or copyrighted materials submitted to House of Thread.

The Client agrees to indemnify and hold House of Thread harmless from any claims arising from unauthorized use of intellectual property provided by the Client.

11. Photography and Marketing

Unless otherwise requested in writing by the Client, House of Thread reserves the right to photograph completed products and use such photographs for marketing, advertising, social media, portfolio display, and promotional purposes.

12. Limitation of Liability

To the fullest extent permitted by law, House of Thread’s liability for any claim arising from an order shall be limited to the amount paid by the Client for the specific order in question.

Under no circumstances shall House of Thread be liable for indirect, incidental, consequential, special, or punitive damages.

13. Governing Law

These terms shall be governed by and interpreted under the laws of the State of South Dakota.

14. Entire Agreement

These terms and conditions constitute the entire agreement between House of Thread and the Client and supersede any prior discussions, representations, or understandings.
